These terms and conditions are intended to define the terms of distance selling between Trois Kilos Sept and the user, from order placement to payment and delivery. They govern all the necessary steps for placing an order and ensure the monitoring of that order between the contracting parties.

Placing an order implies irrevocable acceptance of the general terms and conditions of sale. As the general terms and conditions may be subject to modifications, the applicable conditions are those in force on the website www.troiskilossept.com at the date the order is placed by the user.

The user declares:

 - have the legal capacity to enter into this contract

 - not purchase products for the purpose of reselling them

 - not be a trader

2. Products

The products offered for sale by Trois Kilos Sept are those listed on the website www.troiskilossept.com, on the day the site is consulted by the user.

Products are available for sale subject to available stock.

The visual perception of this product's colors may vary from this indication, from one person to another and, depending on the screen settings and the brightness of the room or location in which the computer, mobile phone or tablet used to browse the website www.troiskilossept.com is situated.

 

3. Prices

Prices are shown in euros including VAT and excluding delivery costs, which remain the responsibility of the user unless otherwise specified.

The prices shown take into account the VAT applicable on the day of the order. If the rate were to be modified, these changes could be reflected in the price of items without the user being informed in advance.

Trois Kilos Sept reserves the right to modify its prices at any time. Products will be invoiced based on the rates in effect at the time the order is recorded.

For orders to be shipped to countries outside the European Union, as well as to French overseas departments and territories, products are sold excluding taxes and any customs duties or other local taxes are the responsibility of the recipient.

 

4. Order

Any order constitutes express and irrevocable acceptance of the prices and descriptions of the products available for sale.

The user declares that they have read and irrevocably accepted these general terms and conditions of sale before placing their order. Validation of the order therefore constitutes acceptance of the general terms and conditions of sale.

In order to allow the user to review their order before final confirmation, Trois Kilos Sept has created validation and acceptance screens. The order will only be definitively recorded upon the last validation of the payment screen by bank card, PayPal, bank transfer, or check. From the moment of the last acceptance click, the order is considered irrevocable. From the moment the order is recorded, an email will be sent to the user. This email confirms that the order has been received by Trois Kilos Sept.

5. Payment

 - For delivery in Metropolitan France: Payment is made online by credit card, PayPal, GooglePay, ApplePay.

In the case of an online payment by bank card, and in order to ensure payment security, NOVATEX (Trois Kilos Sept) uses the Mollie secure payment service. Bank details are encrypted (SSL security standard) and therefore do not travel in plain text over the internet network.

Mollie's payment interface uses 3D Secure technology. This is a system developed by the two bank card networks Visa and MasterCard to authenticate bank cardholders and thus prevent any fraudulent use of the latter. In addition to the card number, expiry date, and security code, with the 3D Secure system, the cardholder must authenticate themselves on their bank's interface, to which they are automatically redirected, by entering a code or personal information previously sent to them by their bank. Once authenticated, the cardholder's transaction will be authorized or declined by their bank.

- For delivery outside Metropolitan France: Payment is made by bank card, PayPal, GooglePay, ApplePay, as well as certain dedicated cards depending on the country (e.g. Bancontact for Belgium, Blik for Poland, etc.)

For online payments by bank card:

The accepted cards are Carte Bleue, Visa, and Mastercard.

Trois Kilos Sept also reserves the right to suspend or cancel any order and/or delivery, in the event of non-payment of any amount owed by the customer, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the website www.troiskilossept.com

Once payment for an order has been recorded and validated by Trois Kilos Sept, a delivery note will be inserted in the parcel containing the ordered product(s). The user who placed an order will be able to print their invoice by logging into the website, in the order history section provided for this purpose.

6. Payment security

In order to ensure payment security, Trois Kilos Sept uses the Mollie secure payment service. Bank details are encrypted (SSL security standard) and therefore do not travel in plain text over the internet network.

Trois Kilos Sept reserves the right to request a photocopy of the customer's identity card and bank card for any payment by bank card (front: only the first 4 digits and back: only the last 2 digits).

 Depending on the documents received, Trois Kilos Sept then reserves the right to verify the personal data and documents provided by the customer and to take the measures deemed necessary (request for supporting documents or cancellation of the order) to ensure that the person whose bank account is debited is indeed the person who placed the order, and to prevent any fraudulent use of bank card numbers.

 In the event of non-receipt by Trois Kilos Sept of the requested supporting documents and/or in the event that Trois Kilos Sept has doubts about the authenticity of the documents received, Trois Kilos Sept also reserves the right to suspend or cancel any order and/or delivery.

The same applies, regardless of the nature and level of execution of an order, in the event of non-payment of any amount owed by the customer, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the website www.troiskilossept.com.

 

7. Shipping costs, delivery conditions and timelines

Except in cases of force majeure, delivery times will be, within the limits of available stock, those indicated below. 

Trois Kilos Sept reserves the right to choose the carrier and guarantees the proper delivery of products.

Shipping costs are free for any order of €35 incl. VAT or more for delivery in Metropolitan France with the carrier Mondial Relay, and from €50 incl. VAT for delivery in Metropolitan France by Colissimo without signature.

   - Delivery area: France, Corsica, French Overseas Departments, and international (see "Delivery" tab)

   - Average delivery time: 2 to 4 business days (for delivery in Metropolitan France, including preparation time)

   - Delivery by Post (tracked Colissimo) or by Mondial Relay at a local retailer (for delivery in Metropolitan France)

   - Shipping costs: Flat rate between €7.90 and €9.90 incl. VAT with La Poste Colissimo tracked delivery for Metropolitan France (depending on the delivery method chosen) or: flat rate of €4.99 incl. VAT for delivery with Mondial Relay in France as well. All rates are available in the "Delivery" tab.

For delivery by Mondial Relay, the customer will receive an email from Trois Kilos Sept once their parcel has been dispatched and taken over by the carrier. The customer will then normally be informed by email (at the address provided when placing the order) and by Mondial Relay of their parcel's arrival at the chosen pick-up point. 

It may happen that the pick-up point initially chosen by the customer is no longer able to receive parcels (annual closure, overload, etc.) and refuses new deliveries. In this case, Mondial Relay will deliver the parcel to the relay point closest to the one initially chosen by the customer and which is able to receive parcels at the time of delivery. The new contact details of this pick-up point will be provided to the customer in the email sent to inform them that their parcel is available for collection. 

However, if this is not the case and no email has been sent to the customer to inform them that their parcel is available at their local pick-up point, Trois Kilos Sept cannot be held liable if, due to the parcel not being collected within 14 days (day of arrival, weekends and public holidays included), the customer's parcel is returned by Mondial Relay to the premises of Trois Kilos Sept.

In this case, upon receipt of the returned parcel, Trois Kilos Sept will contact the customer at the contact details provided when placing the order (email, phone) in order to offer a reshipment or a refund of their order. In the case of reshipment, the shipping costs will remain the sole responsibility of the customer. They will need to pay this amount to Trois Kilos Sept, i.e. €4.99 incl. VAT for a new shipment via Mondial Relay, by check or bank transfer.

The same applies for delivery by Post: Trois Kilos Sept will send the customer an email to provide their parcel number and inform them of the dispatch of their order.

In the event that the customer is absent when the delivery driver calls, a delivery notice will be left in their mailbox. 

The customer will then have 15 days to collect their parcel from the post office indicated on the delivery notice, with a valid ID.

After these 15 days, the parcel will be returned to Trois Kilos Sept, which cannot in any way be held responsible for this return to the sender. Upon receipt of this returned parcel, Trois Kilos Sept nonetheless undertakes to contact the customer (at the contact details provided when placing the order) to offer them a reshipment or a refund of their order.  

Again, if the customer wishes to have their order reshipped, they must first pay Trois Kilos Sept the amount of the reshipping costs by check, PayPal, or bank transfer. This amount will depend on the weight of their order and will be communicated to them by Trois Kilos Sept.

Finally, for delivery by GLS, here are the delivery terms:

Our deliveries are guaranteed within 24 hours for most departments. To Europe, parcels destined for neighboring countries are delivered within 24 to 96 hours; for more distant destinations, delivery times are generally between 72 and 120 hours.

If your delivery benefits from the FlexDeliveryService, we will notify you when your parcel is out for delivery.

Our deliveries take place Monday to Friday, from 8 am to 6 pm.

If you are absent when our driver calls, a delivery notice will be left in your mailbox so you can arrange a new delivery of your parcel.

GLS will always endeavor to find a trusted third party (concierge, neighbor, etc.) willing to receive your parcel upon signature. If no neighbor is available to receive it, and subject to availability from our partner, your parcel may be delivered to a nearby GLS Relay point.

If neither of these solutions can be implemented, our delivery driver will automatically return your parcel to the GLS agency for a new delivery attempt. If the second delivery attempt is also unsuccessful, the parcel will be returned to your sender after a holding period of 10 working days during which you may collect your parcel from the GLS agency.

In all cases, GLS will leave a delivery notice.

Can GLS deliver your parcel to a GLS relay point?

Yes, provided that your sender has subscribed to the appropriate services. You have the option to have your parcel delivered to one of our GLS Relay points. To collect your parcel, you will simply need to present a valid identity card or passport along with the delivery notice.

ATTENTION: In the event of an error in the delivery address entered by the customer, which prevents the carrier from properly delivering the parcel to its destination, Trois Kilos Sept cannot be held liable in any way, regardless of the nature of the issue.

In this case, the parcel will be returned to Trois Kilos Sept's premises, which will contact the customer using the contact details provided when placing the order, in order to obtain a correct delivery address. From that point on, the parcel can be reshipped to the correct address (at the customer's choice) but this reshipment will remain the sole responsibility of the customer. The customer will be able to receive their parcel upon reimbursement of the shipping costs related to this reshipment.

Conditions required for returns

From the date of receipt of their order, the customer has a legal withdrawal period of fourteen (14) days to exercise their right of withdrawal without having to justify the reasons. This period runs from the day the order is received by the customer or a third party, other than the carrier designated by the customer. Or from the day the customer collected their order from a pick-up point.

From June 19, 2026, the customer may exercise their right of withdrawal using a dedicated form, allowing them to obtain a copy of their right of withdrawal.

The Customer may then exercise their right of withdrawal, without having to justify their decision, by specifying the order or the products concerned by this withdrawal.

This withdrawal form allows the customer to keep a record of the request (an acknowledgment of receipt is sent upon validation of the request), as well as Trois Kilos Sept.

Once the withdrawal form has been submitted, it is instantly received by Trois Kilos Sept. 

The customer must send the product(s) concerned to the premises of Trois Kilos Sept within a reasonable time and, at the latest, within fourteen (14) days of sending the withdrawal form.

Return shipping costs remain the responsibility of the customer.

Returns must be made in their original condition, unused and unwashed, allowing them to be resold as new.

For returns from Metropolitan France, we also offer the option to purchase online directly on our website Colissimo return labels and via the Mondial Relay website.

Upon receipt, a quality check will be carried out on the merchandise received. No used item or item damaged by the customer may be subject to any request for exchange, credit, or refund.

It is the sole and exclusive responsibility of the customer to ensure that the packaging of their return parcel meets the requirements of the carrier they choose to send merchandise back to us.

Trois Kilos Sept reserves the right to refuse receipt of parcels received in a damaged condition (opened, deformed, punctured, torn, ...). Provided that the customer has communicated their contact details to the carrier when sending their return parcel, the parcel in question will then be automatically returned by the carrier as-is to the customer. 

Available return methods

 - Exchange for one or more other items whose total selling price does not exceed that already paid by the buyer in their initial order (subject to stock availability on the date of receipt of the returned parcel).

 - The creation of a store credit applicable to the buyer's next order and valid for 2 months from the date of issue.

 - The refund, which is processed upon receipt of the item returned by the customer to Trois Kilos Sept (and within a maximum of 14 working days following that receipt), excluding shipping costs related to this return, will be made as follows:

   - by check if the customer paid for their order by check

   - by bank transfer if the customer paid for their order by bank transfer (in this case, bank account details will be requested from the customer in order to carry out the transfer)

   - by credit back to the bank card used when placing the order if the customer paid by CB/Visa/Mastercard

   - by credit back to the PayPal account used when placing the order if the customer paid by PayPal

 

* During sales, promotional periods and commercial campaigns, the return period is also 14 days.

9. Guarantee

All our Products benefit from legal guarantees, provided that they have been used normally and that the care instructions have been followed.

Legal guarantee of conforming delivery

In accordance with Article L217-4 of the Consumer Code, the seller is required to deliver goods that conform to the contract and is liable for any conformity defects existing at the time of delivery. The seller is also liable for conformity defects resulting from the packaging, assembly instructions, or installation when the latter has been made the seller's responsibility under the contract or was carried out under the seller's responsibility.

Pursuant to Article L217-5 of the French Consumer Code, in order to comply with the contract, the goods must: 1º Be fit for the purpose ordinarily expected of similar goods and, where applicable: - correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model; - present the qualities that a buyer may legitimately expect in light of public statements made by the seller, the manufacturer or their representative, particularly in advertising or labeling; 2º Or present the characteristics defined by mutual agreement between the parties or be fit for any special purpose sought by the buyer, communicated to the seller and accepted by the seller.

Legal guarantee against hidden defects and legal guarantee of conformity

In accordance with Article 1641 of the Civil Code, the seller is liable for the guarantee in respect of hidden defects in the item sold that render it unfit for the purpose for which it was intended, or that so diminish that use that the buyer would not have purchased it, or would have paid a lower price for it, had they been aware of the defects.

In the event of a legal guarantee of conformity claim:

- The buyer has a period of 2 years from the delivery of the goods to take action (Article L217-12 of the Consumer Code).

- The buyer may choose between repair and replacement of the goods (Article L217-9 of the Consumer Code). However, the seller may not proceed according to the buyer's choice if that choice entails a manifestly disproportionate cost compared to the other option, taking into account the value of the goods or the significance of the defect. In that case, the seller is required to proceed, unless impossible, according to the option not chosen by the buyer. 

The buyer is not required to prove the existence of the conformity defect of the goods during the 6 months following delivery of the goods (Article L217-7 of the Consumer Code).

For goods purchased after March 18, 2016: all conformity defects appearing within 2 years following the purchase, except for second-hand goods for which the period will be maintained at 6 months, are presumed to exist.

The legal guarantee of conformity applies independently of the commercial guarantee granted by Trois Kilos Sept under Article 8 of these general terms and conditions of sale.

In the event that the guarantee against hidden defects is invoked:

- The buyer may choose to return the item and be refunded the price, or to keep the item and be refunded part of the price, as determined by experts (Article 1644 of the Civil Code).

- The action resulting from latent defects must be brought by the buyer within two years of the discovery of the defect (Article 1648, paragraph 1 of the Civil Code).

- The seller is liable for defects in the conformity of the goods to the contract under the conditions of Article L. 211-4 et seq. and for hidden defects in the item sold under the conditions set out in Articles 1641*

(i) when acting under the legal guarantee of conformity, the consumer has a period of two years from the delivery of the goods to take action; may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L. 211-9 of the Consumer Code; is not required to prove the existence of the conformity defect of the goods during the six months following delivery of the goods (period extended to twenty-four months from March 18, 2016, except for second-hand goods); without prejudice to any commercial guarantee that may have been granted.
(ii) when acting on the basis of the warranty against hidden defects, the buyer may choose between cancellation of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.

If non-conformity or a defect affecting one or more product(s) is identified within the aforementioned time limits, the Buyer may return the Products to the Trois Kilos Sept Consumer Service at the following address: NOVATEX - Trois Kilos Sept Consumer Services – 59, route du Bief du Moulin - 73470 Novalaise – France, or contact the Trois Kilos Sept Consumer Service at the following number 04 56 42 04 43 (Monday to Friday from 8:30 am to 1:00 pm) who will confirm the procedure to follow.

If the above-mentioned conditions are met, Trois Kilos Sept will proceed with the exchange of the Product(s) presenting such conformity defects or proven faults attributable to Trois Kilos Sept, or failing that, will reimburse the Buyer for the amount of such Product(s), as well as the return shipping costs paid by the Buyer, where applicable.

10. Right to object to telephone canvassing

As part of your order on the TroisKilosSept website, a phone number is collected for the purpose of tracking that order.

You have the option to register for free on a telephone canvassing opt-out list BLOCTEL (www.bloctel.gouv.fr) so that you are no longer contacted by telephone by a professional with whom you have no ongoing contractual relationship, in accordance with Law no. 2014-344 of March 17, 2014 relating to consumption.

11. Personal Data Protection

Personal information

Personal information required for the processing and delivery of orders and the issuing of invoices means that the collection of such information in the context of distance selling is mandatory. This information is strictly confidential and is intended solely for NOVATEX company.

In accordance with Law no. 78-17 of January 6, 1978 relating to data processing, files, and individual liberties, the processing of personal information collected on the website www.troiskilossept.com has been declared to the CNIL. The user has the right to access, modify, rectify, and delete data relating to them. To exercise this right, the user must send a letter to the following address:

12. Intellectual property

All elements of the Trois Kilos Sept website, including texts, visuals, and audio content, are protected by copyright and trademarks. They are the exclusive property of NOVATEX company.

The information provided may not be copied, downloaded, distributed, or otherwise reproduced or disclosed without the prior written consent of Trois Kilos Sept (NOVATEX)

13. Liability

NOVATEX company has, for all stages of access to the site, the order process, delivery, or subsequent services, only a best-efforts obligation. NOVATEX company cannot be held liable for any inconvenience or damage inherent to the use of the internet network, including a service interruption, an external intrusion, or the presence of computer viruses, or any event qualified as force majeure, in accordance with case law.

Furthermore, Trois Kilos Sept disclaims any liability for failure to fulfill its contractual obligations in the event of force majeure or an act of God, including but not limited to strike, fire, disaster, breakdown, and more generally any event preventing the proper fulfillment of orders.

These terms and conditions apply for the entire duration that the services offered by Trois Kilos Sept are available online.

16. Applicable Law - Disputes

These general terms and conditions of sale are subject to French law.

In the event of a dispute, the parties agree, before taking any legal action, to seek an amicable solution.

In accordance with the provisions of the Consumer Code concerning "the consumer dispute mediation process", the customer has the right to use free of charge the mediation service offered by Trois Kilos Sept. From February 5, 2025

The proposed mediator is CM2C (Centre de la Médiation de la Consommation de Conciliateur de Justice).

Only French courts shall have jurisdiction.
