Hereinafter "the user"

These conditions aim to define the terms of distance selling between Trois Kilos Sept and the user, from order to payment and delivery. They regulate all the steps necessary for placing the order and ensure the follow-up of this order between the contracting parties.

The order implies irrevocable acceptance of the general terms and conditions of sale. As the general conditions may be subject to modifications, the applicable conditions are those in force on the website www.troiskilossept.com on the date the order is placed by the user.

The user declares:

 - have the capacity to enter into this contract

 - not to purchase products with the intention of reselling them

 not to be a trader

Products

The products offered for sale by Trois Kilos Sept are those appearing on the website www.troiskilossept.com, on the day the user consults the site.

Products are available for sale within the limits of available stock.

The visual perception of the colors of this product may vary from this indication, from one person to another and, depending on the screen settings and the brightness of the room or place where the computer, mobile or tablet used to browse the website www.troiskilossept.com is located

 

Price

Prices are presented in euros including VAT and excluding delivery costs which remain the responsibility of the user unless otherwise specified.

The prices indicated take into account the VAT applicable on the day of the order. If the rate were to be modified, these changes could be reflected in the price of items without the user being notified beforehand.

Trois Kilos Sept reserves the right to modify its prices at any time. Products will be invoiced based on the rates in effect at the time the order is placed.

For orders to be shipped to countries outside the European Union, as well as to French overseas departments and territories, products are sold tax-free and any customs duties or other local taxes are the responsibility of the recipient.

 

Order

Any order constitutes express and irrevocable acceptance of the prices and descriptions of products available for sale.

The user declares having read and irrevocably accepted these general terms and conditions of sale before placing their order. Validation of the order therefore constitutes acceptance of the general terms and conditions of sale.

In order to allow the user to review their order before validating it definitively, Trois Kilos Sept has created validation and acceptance screens. The order will only be definitively recorded at the last validation of the payment screen for the order by bank card, PayPal, bank transfer or check. From the last acceptance click, the order is considered irrevocable. From the registration of the order, an email will be sent to the user. This email confirms that the order has been registered by Trois Kilos Sept.

Payment

- For delivery in Metropolitan France: Payment is made online by bank card, PayPal, GooglePay, ApplePay.

In the case of online payment by bank card and, to ensure payment security, the company NOVATEX (Trois Kilos Sept) uses the Mollie secure payment service. Bank data is encrypted (SSL security standard) and therefore does not circulate in clear text over the internet.

Mollie's payment interface uses 3D secure technology. This is a system developed by the two bank card networks Visa and MasterCard to authenticate bank cardholders and thus avoid any fraudulent use of the cards. In addition to the number, expiry date and cryptogram, with the 3D Secure system, the cardholder must authenticate themselves on an interface of their bank to which they are automatically redirected, by entering a code or personal information that their bank will have transmitted to them beforehand. Once authenticated, the cardholder will see their transaction authorized or refused by their bank.

- For delivery outside Metropolitan France: Payment is made by bank card, PayPal, GooglePay, ApplePay, as well as certain dedicated cards depending on the country (e.g. Bancontact for Belgium, Blik for Poland, etc.)

For online payments by bank card:

The accepted cards are Carte Bleue, Visa, Mastercard.

Trois Kilos Sept also reserves the right to suspend or cancel any order and/or delivery, in case of non-payment of any amount that would be due by the customer, in case of payment incident, or in case of fraud or attempted fraud relating to the use of the website www.troiskilossept.com

Once payment for an order is recorded and validated by Trois Kilos Sept, a delivery note will be inserted in the parcel containing the ordered product(s). The user who has placed an order will have the option to print their invoice by logging onto the website, in the order history section provided for this purpose.

Payment Security

To ensure payment security, the company Trois Kilos Sept uses the Mollie secure payment service. Bank data is encrypted (SSL security standard) and therefore does not circulate in clear text over the internet.

Trois Kilos Sept reserves the right to request a photocopy of the customer's identity card and bank card for any payment by bank card (front: only the first 4 digits and back: only the last 2 digits).

Depending on the documents received, Trois Kilos Sept reserves the right to verify the personal data and documents provided by the customer and to adopt the measures deemed necessary (request for supporting documents or cancellation of the order) to ensure that the person whose bank account is debited is indeed the one who placed the order and to avoid any fraudulent use of bank card numbers.

In case of non-receipt by Trois Kilos Sept of the requested supporting documents and/or in the event that Trois Kilos Sept doubts the authenticity of the documents received, Trois Kilos Sept also reserves the right to suspend or cancel any order and/or delivery.

The same applies, regardless of the nature and level of execution of an order, in case of non-payment of any amount that would be due by the customer, in case of payment incident, or in case of fraud or attempted fraud relating to the use of the website www.troiskilossept.com.

 

Shipping costs, conditions and delivery times

Except in cases of force majeure, delivery times will be, within the limits of available stocks, those indicated below. 

Trois Kilos Sept reserves the right to choose the carrier and guarantees the proper delivery of products.

Shipping costs are free for any order of €35 including tax and more for delivery in Metropolitan France with the carrier Mondial Relay, and from €50 including tax for delivery in Metropolitan France by Colissimo without signature.

- Delivery area: France, Corsica, French overseas departments and international (see "Delivery" tab)

   - Average delivery time: 2 to 4 business days (for delivery in Metropolitan France, preparation time included)

   - Delivery by the Post Office (Colissimo with tracking) or by Mondial Relay at a local merchant (for delivery in Metropolitan France)

- Shipping costs: Flat rate between €7.90 and €9.90 including VAT with the Post Office by Colissimo with tracking for Metropolitan France (depending on the delivery method chosen) or: flat rate of €4.99 including VAT for delivery with Mondial Relay in France as well. All rates are available in the "Delivery" tab.

For delivery by Mondial Relay, the customer will receive an email from Trois Kilos Sept once their package has been shipped and picked up by the carrier. Then, the customer will normally be informed by email (at the address indicated when placing their order) and by Mondial Relay of the arrival of their package at the chosen relay point.

Sometimes the merchant initially chosen by the customer is no longer able to receive parcels (annual closure, overload, etc.) and refuses new deliveries. In this case, Mondial Relay will deliver the parcel to the nearest relay point to the one initially chosen by the customer and able to receive parcels at the time of delivery. The new contact details of this merchant will be indicated to the customer in the email that will be sent to inform them that their parcel is available for collection. 

However, if this is not the case and no email has been sent to the customer to inform them that their parcel is available at their local merchant, Trois Kilos Sept cannot be held responsible if, for lack of having been collected within 14 days (including day of arrival, weekends and public holidays), the customer's parcel is returned by Mondial Relay to Trois Kilos Sept's premises.

In this case and upon receipt of the return package, Trois Kilos Sept will contact the customer at the contact details provided by the latter when placing their order (email, telephone) to offer them a reshipment or a refund of their order. In the case of reshipment, shipping costs will remain the exclusive responsibility of the customer. They will have to pay this amount to Trois Kilos Sept, i.e. €4.99 including tax for a new shipment by Mondial Relay, by check or bank transfer.

The same applies for delivery by the Post Office: Trois Kilos Sept will send an email to the customer to provide their parcel number and inform them of the shipment of their order.

In the event that the customer is absent when the delivery person passes, a delivery notice will be left in their mailbox. 

The customer will then have 15 days to collect their parcel at the post office mentioned on this notice with proof of identity.

Beyond these 15 days, the parcel will be returned to Trois Kilos Sept, which cannot be held responsible in any way for this return to sender. Upon receipt of this return parcel, Trois Kilos Sept nevertheless undertakes to contact the customer (at the contact details provided by the customer when placing their order) to offer them a re-shipment or refund of their order.  

Again, if the customer wishes to have their order reshipped, they must first pay Trois Kilos Sept the amount of the costs related to this reshipment by check, PayPal or bank transfer. This amount will depend on the weight of their order and will be communicated to them by Trois Kilos Sept.

Finally, for delivery by GLS, here are the delivery terms:

Our deliveries are made within 24 hours in most departments. To Europe, parcels destined for neighboring countries are delivered between 24 hours and 96 hours, for more distant destinations delivery times are generally between 72 hours and 120 hours.

If your delivery benefits from the FlexDeliveryService, we will inform you of the dispatch of your package for delivery.

Our deliveries are made Monday to Friday, from 8 AM to 6 PM.

If you are absent when our driver passes, a delivery notice will be left in your mailbox allowing you to arrange a new delivery of your package.

GLS will always endeavor to find a trusted third party (concierge, neighbor, etc.) accepting to receive your parcel against signature. If no neighbor can receive it, and subject to our partner's availability, your parcel may be delivered to a nearby GLS Relay point.

If either of these solutions cannot be implemented, our delivery person will automatically return your parcel to the GLS depot for a new delivery attempt. If the delivery person's second visit also proves unsuccessful, the parcel will be returned to your sender after a holding period of 10 working days during which you may collect your parcel at the GLS depot.

In all cases, GLS will leave a delivery notice.

Can GLS drop off your parcel at a GLS relay point?

Yes, if your sender has subscribed to the appropriate services. You have the option to have your parcel delivered to one of our GLS Relay points. To collect your parcel, you will simply need to present a valid identity card or passport as well as the delivery notice.

ATTENTION: In the case of an error by the customer when entering the delivery address, which does not allow the carrier to properly deliver the package to its destination, Trois Kilos Sept's liability cannot be engaged for any reason whatsoever.

In this case, the parcel will be returned to Trois Kilos Sept's premises, who will contact the customer using the contact details provided by the customer, in order to obtain a correct delivery address. The parcel can then be reshipped to the correct address (at the customer's choice) but this reshipment will remain the exclusive responsibility of the customer. The customer may receive their parcel upon reimbursement of the shipping costs related to this reshipment.

In this case, the parcel will be returned to Trois Kilos Sept's premises, who will contact the customer using the contact details provided by the customer, in order to obtain a correct delivery address. The parcel can then be reshipped to the correct address (at the customer's choice) but this reshipment will remain the exclusive responsibility of the customer. The customer may receive their parcel upon reimbursement of the shipping costs related to this reshipment.

Conditions necessary for return

From the date of receipt of the order, the customer has a legal withdrawal period of fourteen (14) days to exercise this right without having to provide justification. This period runs from the day of receipt of the order by the customer or a third party, other than the carrier designated by them, or from the day the customer collected their order at a relay point.

The Customer may exercise their right of withdrawal, without having to justify their decision, by any means and in particular by postal mail or by email expressing their wish to withdraw without any ambiguity, and mentioning the Order concerned by this withdrawal. To exercise their right of withdrawal, the Customer may send us the completed withdrawal form to the following address:

Once the withdrawal form or declaration has been sent to Trois Kilos Sept, at the latest within fourteen (14) days following receipt of the Order, the Customer must send the Product(s) concerned to the Seller, within a reasonable period and, at the latest, within fourteen (14) days from sending the withdrawal form or declaration to the Seller.

Return shipping costs remain the responsibility of the customer.

Returns must be made in their original condition without having been used or washed, allowing their resale as new.

If needed, the customer who wishes to make a return can download and use a pre-filled return form.

For returns from Metropolitan France, we also offer the online purchase directly on our site of Colissimo return labels and via the Mondial Relay website.

Upon receipt, a quality control will be performed on the received goods. No used or damaged item by the customer may be subject to any request for exchange, credit or refund.

It is the sole and exclusive responsibility of the customer to ensure that the packaging of their return parcel meets the requirements of the carrier they will choose to send merchandise back to us.

Trois Kilos Sept reserves the right to refuse receipt of parcels received damaged (opened, deformed, punctured, torn, etc.). Provided that the customer has communicated their contact details to the carrier when sending their return parcel, the parcel in question will then be automatically returned by the carrier in its current state to the customer.

Return methods offered

 Exchange with one or more other items whose total sale price does not exceed that already paid by the buyer during their initial order (and subject to stock availability on the date of receipt of the return package).

 - The creation of a credit note to be used on the buyer's next order and valid for 2 months from its issue.

 - The refund, which is made upon receipt of the item returned by the customer to Trois Kilos Sept (and within a maximum of 14 working days following this receipt) excluding shipping costs related to this return, in the following manner:

   by check if the customer paid for their order by check

   by bank transfer if the customer paid for their order by bank transfer (in this case, an IBAN will be requested from the customer to be able to make this transfer)

   - by credit to the bank card used when placing the order if the customer paid for their order by bank card

   - by credit to the PayPal account used when placing the order if the customer paid for their order by PayPal

 

* During sales periods, promotions and commercial operations, the return period is also 14 days.

Warranty

All our Products benefit from legal guarantees, provided that the use has been normal and that the care instructions have been followed.

Legal guarantee of conforming delivery

In accordance with Article L217-4 of the Consumer Code, the seller is required to deliver goods that conform to the contract and is liable for conformity defects existing at the time of delivery. They are also liable for conformity defects resulting from packaging, assembly instructions or installation when this has been their responsibility under the contract or was carried out under their responsibility.

In application of article L217-5 of the Consumer Code, to comply with the contract, the goods must: 1º Be suitable for the use habitually expected of similar goods and, where applicable: - correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model; - present the qualities that a buyer can legitimately expect in view of public statements made by the seller, the producer or their representative, particularly in advertising or labeling; 2º Or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the seller's attention and that the seller has accepted.

Legal guarantee against hidden defects and legal guarantee of conformity

In accordance with Article 1641 of the Civil Code, the seller is liable for the guarantee due to hidden defects of the sold item that make it unfit for the use for which it is intended, or that so diminish that use that the buyer would not have acquired it, or would have given only a lower price, if they had known them.

In case of action under the legal guarantee of conformity:

- The buyer benefits from a period of 2 years from the delivery of the goods to act (Article L217-12 of the Consumer Code).

- The buyer can choose between repair and replacement of the goods (Article L217-9 of the Consumer Code). However, the seller may not proceed according to the buyer's choice if this choice entails a cost that is manifestly disproportionate compared to the other option, taking into account the value of the goods or the importance of the defect. They are then required to proceed, unless impossible, according to the option not chosen by the buyer.

The buyer is exempted from providing proof of the existence of the conformity defect of the goods for 6 months following the delivery of the goods (Article L217-7 of the Consumer Code).

For goods purchased after March 18, 2016: all conformity defects appearing within 2 years following the purchase, except for second-hand goods for which the period will remain at 6 months, are presumed to exist.

The legal guarantee of conformity applies independently of the commercial guarantee granted by Trois Kilos Sept under article 8 of these general terms and conditions of sale.

In case of implementation of the guarantee against hidden defects:

- The buyer has the choice to return the item and have the price refunded, or to keep the item and have part of the price returned, as determined by experts (Article 1644 of the Civil Code).

- The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect (Article 1648 paragraph 1 of the Civil Code).

- The seller is liable for defects in conformity of the goods to the contract under the conditions of article L. 211-4 et seq. and for hidden defects of the thing sold under the conditions provided in articles 1641*

(i) when acting under the legal guarantee of conformity, the consumer benefits from a period of two years from the delivery of the goods to act; can choose between repair or replacement of the goods, subject to the cost conditions provided for by article L. 211-9 of the Consumer Code; is exempted from providing proof of the existence of the conformity defect of the goods for six months following the delivery of the goods (period extended to twenty-four months from March 18, 2016, except for second-hand goods); without prejudice to any commercial guarantee that may be granted.
(ii) when acting on the basis of the warranty for hidden defects, they may choose between rescission of the sale or a reduction in the sale price in accordance with article 1644 of the Civil Code.

If non-conformity or a defect affecting one or more product(s) is found within the aforementioned timeframes, the Buyer may return the Products to the Trois Kilos Sept Customer Service at the following address: NOVATEX - Trois Kilos Sept Customer Service – 59, route du Bief du Moulin - 73470 Novalaise – France, or contact the Trois Kilos Sept Customer Service at the following number 04 56 42 04 43 (Monday to Friday from 8:30 AM to 1:00 PM) who will confirm the procedure to follow.

If the above-mentioned conditions are met, Trois Kilos Sept will proceed with the exchange of the Product(s) presenting such proven conformity defects or defects whose origin is attributable to Trois Kilos Sept or, failing that, will refund the Buyer the amount of such Product(s), as well as the return costs of the Products paid by the Buyer, if applicable.

Right to oppose telephone canvassing

As part of your order on the TroisKilosSept website, a telephone number is collected for order tracking purposes.

You have the option to register free of charge on an opposition list to telephone canvassing BLOCTEL (www.bloctel.gouv.fr) in order to no longer be canvassed by telephone by a professional with whom you do not have an ongoing contractual relationship, in accordance with law no. 2014-344 of March 17, 2014 relating to consumption.

Liability

The responsibility of the company NOVATEX cannot be engaged for all inconveniences or damages inherent in the use of the internet network, in particular a service interruption, an external intrusion or the presence of computer viruses, or events qualified as force majeure, in accordance with case law.

Applicable Law-Disputes

These general terms and conditions of sale are subject to French law.

In case of dispute, the parties undertake, before any legal action, to seek an amicable solution.

In accordance with the provisions of the Consumer Code concerning "the consumer dispute mediation process", the customer has the right to use free of charge the mediation service offered by Trois Kilos Sept. From February 5, 2025

The proposed mediator is CM2C (Centre de la Médiation de la Consommation de Conciliateur de Justice).
