Hereinafter "the user"
These conditions aim to define the terms of distance selling between Trois Kilos Sept and the user, from order to payment and delivery. They govern all the steps necessary for placing the order and ensure the follow-up of this order between the contracting parties.
The order implies irrevocable acceptance of the general terms and conditions of sale. As the general conditions may be subject to modifications, the applicable conditions are those in effect on www.troiskilossept.com at the date the user places the order.
The user declares:
- have the capacity to conclude this contract
- not to purchase products for the purpose of reselling them
- not be a merchant
Products
The products offered for sale by Trois Kilos Sept are those appearing on the website www.troiskilossept.com, on the day the user visits the site.
Products are available for sale while stocks last.
The visual perception of this product's colors may vary from this indication, from person to person, and depending on screen settings and room brightness where the computer, mobile phone, or tablet used to browse the website www.troiskilossept.com is located
Price
Prices are shown in euros including VAT and excluding delivery costs which remain the responsibility of the user unless special conditions apply.
The prices shown include VAT applicable on the day of the order. If the rate were to change, these changes could be reflected in the price of items without prior notice to the user.
Trois Kilos Sept reserves the right to modify its prices at any time. Products will be invoiced based on the rates in effect at the time the order is registered.
For orders to be shipped to countries outside the European Union, as well as to French overseas departments and territories, products are sold tax-free and any customs duties or other local taxes are the responsibility of the recipient.
Order
Any order constitutes express and irrevocable acceptance of the prices and descriptions of products available for sale.
The user declares having read and irrevocably accepted these general terms of sale before placing their order. Order validation therefore constitutes acceptance of the general terms of sale.
In order to allow the user to review their order before final validation, Trois Kilos Sept has created validation and acceptance screens. The order will only be definitively registered at the last validation of the order payment screen by credit card, PayPal, bank transfer, or check. From the last acceptance click, the order is considered irrevocable. It is provided that, from the registration of the order, an email will be sent to the user. This email confirms that the order has been taken into account by Trois Kilos Sept.

In the case of online payment by credit card, and to ensure payment security, NOVATEX company (Trois Kilos Sept) uses the secure payment service PAYPLUG. Bank data is encrypted (SSL security standard) and therefore does not circulate in clear text on the internet network.
PAYPLUG's payment interface uses 3D Secure technology. This is a system developed by the two bank card networks Visa and MasterCard to authenticate bank card holders and thus avoid any fraudulent use of these cards. In addition to the number, expiration date, and security code, with the 3D Secure system, the cardholder must authenticate on an interface of their bank to which they are automatically redirected, by entering a code or personal information that their bank will have provided to them beforehand. Once authenticated, the cardholder will see their transaction authorized or refused by their bank.
In the case of payment by check or bank transfer, the delivery time will be extended since the order shipping process will only begin after receipt and cashing of the check or transfer.
In the case of payment by check or bank transfer, the customer has 15 days to send their check payment to Trois Kilos Sept or to make their bank transfer. Beyond this period, Trois Kilos Sept reserves the right to cancel the order in question, for logistical stock management purposes.
- For delivery outside Metropolitan France: Payment can only be made via PayPal or bank transfer.
For online payments by credit card:
The accepted cards are Carte Bleue, Visa, Mastercard.
Trois Kilos Sept also reserves the right to suspend or cancel any order and/or delivery, in case of non-payment of any amount due by the customer, in case of payment incident, or in case of fraud or attempted fraud related to the use of the website www.troiskilossept.com
Once payment for an order has been registered and validated by Trois Kilos Sept, a delivery note will be inserted in the package containing the ordered product(s). Users who have placed an order will be able to print their invoice by logging into the site, in the order history section provided for this purpose.

Payment Security
To ensure payment security, Trois Kilos Sept company uses the secure payment service PayBox Services - Crédit Agricole. Bank data is encrypted (SSL security standard) and therefore does not circulate in clear text on the internet network.
Trois Kilos Sept reserves the right to request a photocopy of the customer's ID card and bank card for any payment by credit card (front: only the first 4 digits and back: only the last 2 digits).
Based on the documents received, Trois Kilos Sept reserves the right to verify personal data and documents provided by the customer and to adopt measures deemed necessary (request for proof or order cancellation) to ensure that the person whose bank account is debited is indeed the one who placed the order and to prevent any fraudulent use of bank card numbers.
In case of non-receipt by Trois Kilos Sept of the requested supporting documents and/or in case Trois Kilos Sept doubts the authenticity of the documents received, Trois Kilos Sept also reserves the right to suspend or cancel any order and/or delivery.
The same applies regardless of the nature and level of execution of an order, in case of non-payment of any amount due by the customer, in case of payment incident, or in case of fraud or attempted fraud relating to the use of the website www.troiskilossept.com.
Shipping costs, conditions, and delivery times
Except in cases of force majeure, delivery times will be, subject to stock availability, those indicated below.
Trois Kilos Sept reserves the right to choose the carrier and guarantees the proper delivery of products.
Shipping is free for any order of €35 including tax and above for delivery in Metropolitan France with Mondial Relay carrier, and from €50 including tax for delivery in Metropolitan France with Colissimo without signature.
- Delivery zone: France, Corsica, French overseas departments and international (see "Delivery" tab)
- Average delivery time: 2 to 4 business days (for delivery in Metropolitan France, including preparation time)
- Delivery by La Poste (Colissimo with tracking) or by Mondial Relay to a local retailer (for delivery in Metropolitan France)
- Shipping costs: Fixed amount between €7.90 and €9.90 including VAT with La Poste Colissimo tracking for Metropolitan France (depending on the chosen delivery method) or: fixed rate of €4.99 including VAT for delivery with Mondial Relay in France as well. All rates are available in the "Delivery" tab.
For delivery by Mondial Relay, the customer will receive an email from Trois Kilos Sept once their package has been shipped and is in the carrier's care. Then, the customer will normally be informed by email (at the address provided during order placement) and by Mondial Relay of their package's arrival at the chosen pickup point.
Sometimes the pickup point initially chosen by the customer is no longer able to receive packages (annual closure, overload, etc.) and refuses new deliveries. In this case, Mondial Relay will deliver the package to the nearest pickup point that is able to receive packages at the time of delivery. The new details of this pickup point will be provided to the customer in the email that will be sent to inform them that their package is available for collection.
However, if this is not the case and no email has been sent to the customer to inform them of their package's availability at their local store, Trois Kilos Sept cannot be held responsible if, due to not being collected within 14 days (including arrival day, weekends and holidays), the customer's package is returned by Mondial Relay to Trois Kilos Sept's premises.
In this case and upon receipt of the return package, Trois Kilos Sept will contact the customer using the contact information provided during order placement (email, phone) to offer either a reshipment or a refund of their order. In case of reshipment, shipping costs will remain the exclusive responsibility of the customer. They must pay this amount to Trois Kilos Sept, which is €4.99 including VAT for a new shipment via Mondial Relay, by check or bank transfer.
The same applies for postal delivery: Trois Kilos Sept will send an email to the customer to provide their package tracking number and inform them of their order's shipment.
If the customer is absent when the delivery person arrives, a delivery notice will be left in their mailbox.
The customer will then have 15 days to collect their package from the post office mentioned on this notice with an ID.
Beyond these 15 days, the package will be returned to Trois Kilos Sept, who cannot be held responsible in any way for this return to sender. Upon receipt of this returned package, Trois Kilos Sept commits to contacting the customer (using the contact information provided during order placement) to offer either a reshipment or a refund of their order.
Again, if the customer wishes to have their order reshipped, they must first pay Trois Kilos Sept the amount of the shipping fees related to this reshipment by check, PayPal, or bank transfer. This amount will depend on the weight of their order and will be communicated to them by Trois Kilos Sept.
Finally, for GLS delivery, here are the delivery terms:
Our deliveries are made within 24 hours in most departments. For Europe, packages to neighboring countries are delivered between 24H and 96H, for more distant destinations delivery times are generally between 72H and 120H.
If your delivery includes the FlexDeliveryService, we will inform you when your package is out for delivery.
Our deliveries are made Monday through Friday, from 8 AM to 6 PM.
If you are absent when our driver passes, a delivery notice will be left in your mailbox allowing you to arrange a new delivery of your package.
GLS will always try to find a trusted third party (concierge, neighbor, etc.) who agrees to receive your package against signature. If no neighbor can receive it, and subject to our partner's availability, your package can be delivered to a nearby GLS Pickup Point.
If neither of these solutions can be implemented, our delivery person will automatically return your package to the GLS agency for a new delivery attempt. If the second delivery attempt is also unsuccessful, the package will be returned to your sender after a holding period of 10 working days during which you can collect your package from the GLS agency.
In all cases, GLS will leave a delivery notice.
Can GLS deliver your package to a GLS pickup point?
Yes, if your sender has subscribed to the appropriate services. You have the option to have your package delivered to one of our GLS Pickup Points. To collect your package, you will simply need to present a valid ID card or passport along with the delivery notice.
ATTENTION: In the case of an error in entry by the customer in the delivery address, which does not allow the carrier to properly route the package to its destination, Trois Kilos Sept cannot be held responsible for any reason whatsoever.
In this case, the package will be returned to Trois Kilos Sept premises who will contact the customer using the contact information provided, to obtain a correct delivery address. Then, the package can be reshipped to the correct address (at the customer's choice) but this reshipment will remain at the exclusive charge of the customer. They can receive their package against payment of the shipping costs related to this reshipment.

Necessary conditions for returns
From the date of receipt of their order, the customer has a legal withdrawal period of fourteen (14) days to exercise this right without having to provide reasons. This period begins from the day the customer or a third party, other than the designated carrier, receives the order. Or from the day the customer picks up their order at a pickup point.
The Customer may exercise their right of withdrawal, without having to justify their decision, by any means including postal mail or email expressing their unambiguous intention to withdraw, mentioning the Order concerned by this withdrawal. To exercise their right of withdrawal, the Customer may send us the withdrawal form completed at the following address:

Once the withdrawal form or declaration has been sent to Trois Kilos Sept, no later than fourteen (14) days following the receipt of the Order, the Customer must send the Product(s) concerned to the Seller within a reasonable time frame and, at the latest, within fourteen (14) days from sending the withdrawal form or declaration to the Seller.
Return shipping costs remain the responsibility of the customer.

Returns must be made in their original condition without having been used or washed, allowing for their re-commercialization as new.
If needed, customers wishing to make a return can download and use a pre-filled return form.
For returns from Metropolitan France, we also offer online purchase directly on our site of Colissimo return labels and via the Mondial Relay website.
Upon receipt, a quality control will be performed on the received merchandise. No used or customer-damaged items can be subject to any exchange, credit note, or refund request.
It is the sole and exclusive responsibility of the customer to ensure that the packaging of their return package meets the requirements of the carrier they choose to send merchandise back to us.
Trois Kilos Sept reserves the right to refuse receipt of damaged packages (opened, deformed, punctured, torn, etc.). Subject to the customer having provided their contact details to the carrier when sending their return package, the package in question will then be automatically returned by the carrier in its current state to the customer.
Available return methods
- Exchange with one or more other items whose total sale price does not exceed that already paid by the buyer during their initial order (subject to stock availability at the time of return package receipt).
- The creation of a credit note to be used on the buyer's next order and valid for 2 months from its issue.
- The refund, which is processed upon receipt of the item returned by the customer to Trois Kilos Sept, (and within a maximum of 14 business days following this receipt) excluding return shipping costs, in the following manner:
- by check if the customer paid for their order by check
- by bank transfer if the customer paid their order by bank transfer (in this case, bank details will be requested from the customer to process this transfer)
- by recrediting the credit card used when placing the order if the customer paid for their order by credit card
- by crediting back the PayPal account used during order placement if the customer paid their order via PayPal
* During sales periods, promotions, and commercial operations, the return period is also 14 days.
Warranty
All our Products benefit from legal warranties, provided that their use has been normal and care instructions have been followed.
Legal guarantee of conformity
In accordance with Article L217-4 of the Consumer Code, the seller is required to deliver goods that conform to the contract and is responsible for any lack of conformity existing at the time of delivery. They are also responsible for any lack of conformity resulting from the packaging, assembly instructions, or installation when this was made their responsibility by the contract or was carried out under their responsibility.
Pursuant to Article L217-5 of the Consumer Code, to be in conformity with the contract, the goods must: 1º Be fit for the purpose normally expected of similar goods and, where applicable: - correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model; - present the qualities that a buyer can legitimately expect in view of public statements made by the seller, the producer or his representative, particularly in advertising or labeling; 2º Or present the characteristics defined by mutual agreement between the parties or be fit for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
Legal warranty against hidden defects and legal warranty of conformity
In accordance with Article 1641 of the Civil Code, the seller is bound by warranty for hidden defects in the item sold that make it unfit for its intended use, or that diminish its use to such an extent that the buyer would not have purchased it, or would have paid a lower price, had they known about them.
In case of legal warranty of conformity action:
- The buyer has 2 years from the delivery of the goods to take action (Article L217-12 of the Consumer Code).
- The buyer can choose between repair and replacement of the goods (Article L217-9 of the Consumer Code). However, the seller may not proceed according to the buyer's choice if this choice entails a cost clearly disproportionate to the other option, considering the value of the goods or the significance of the defect. They must then proceed, unless impossible, according to the option not chosen by the buyer.
The buyer is exempt from proving the existence of the good's lack of conformity during the 6 months following the delivery of the good (Article L217-7 of the Consumer Code).
For goods purchased after March 18, 2016: all conformity defects appearing within 2 years following the purchase, except for second-hand goods which will remain at 6 months, are presumed to exist.
The legal guarantee of conformity applies independently of the commercial warranty granted by Trois Kilos Sept under Article 8 of these general terms and conditions of sale.
In case of implementation of the warranty against hidden defects:
- The buyer has the choice of returning the item and being refunded, or keeping the item and receiving a partial refund, as determined by experts (Article 1644 of the Civil Code).
- Action resulting from latent defects must be initiated by the purchaser within two years from the discovery of the defect (Article 1648 paragraph 1 of the Civil Code).
- The seller is liable for defects in the conformity of the goods to the contract under the conditions of Article L. 211-4 s. and for hidden defects of the item sold under the conditions provided for in Articles 1641*
(i) when acting under the legal guarantee of conformity, the consumer has two years from the delivery of the goods to take action; may choose between repair or replacement of the goods, subject to cost conditions provided for in Article L. 211-9 of the Consumer Code; is exempt from providing proof of the existence of the good's lack of conformity during the six months following the delivery of the goods (period extended to twenty-four months from March 18, 2016, except for second-hand goods); without prejudice to any commercial warranty granted. (ii) when acting on the basis of the warranty against hidden defects, they may choose between canceling the sale or reducing the sale price in accordance with Article 1644 of the Civil Code. |
In case of non-conformity or defect affecting one or more products within the aforementioned periods, the Buyer may return the Products to Trois Kilos Sept Consumer Service at the following address: NOVATEX - Trois Kilos Sept Consumer Services – 59, route du Bief du Moulin - 73470 Novalaise – France, or contact Trois Kilos Sept Consumer service at the following number 04 56 42 04 43 (Monday to Friday from 8:30 AM to 1 PM) who will confirm the procedure to follow.
If the above conditions are met, Trois Kilos Sept will proceed with the exchange of the Product(s) showing such proven conformity defects or flaws whose origin is clearly attributable to Trois Kilos Sept or, failing that, will reimburse the Buyer for the amount of such Product(s), as well as the return shipping costs paid by the Buyer, if applicable.
Right to object to telephone solicitation
As part of your order on the TroisKilosSept website, a phone number is collected for order tracking purposes.
You have the option to register free of charge on the BLOCTEL telephone solicitation opt-out list (www.bloctel.gouv.fr) to avoid being contacted by telephone by professionals with whom you do not have an ongoing contractual relationship, in accordance with law n°2014-344 of March 17, 2014 regarding consumption.

NOVATEX cannot be held liable for any inconvenience or damage inherent to internet network use, including service interruption, external intrusion, computer viruses, or force majeure events, in accordance with case law.
Moreover, Trois Kilos Sept disclaims responsibility for any breach of its contractual obligations in the event of force majeure or fortuitous circumstances, including but not limited to strikes, fire, disaster, breakdown and generally any event that prevents the proper execution of orders.

These general terms and conditions of sale are subject to French legislation.
In case of dispute, the parties commit to seeking an amicable solution before any legal action.
In accordance with the Consumer Code provisions regarding "the consumer dispute mediation process", the customer has the right to use free of charge the mediation service offered by Trois Kilos Sept. From February 05, 2025

Only French courts will have jurisdiction.
